Terms of Service

By accessing or using our AI systems and services, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using our services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms. Your continued use of our services following any updates to these Terms constitutes your acceptance of the revised terms.

Outputs are generated by our systems when you run a tool. Some outputs are produced by artificial intelligence; others, including construction cost figures, are reproduced from published sources and calculated from the inputs you provide. By using our services, you acknowledge and agree that: you are responsible for reviewing and validating outputs before relying on them, publishing them, or acting on them; we do not guarantee that outputs are accurate, complete, error-free, or suitable for any particular purpose; you own the outputs you generate, subject to the intellectual property terms below; AI technology is evolving and output quality may vary between runs.

Our tools run on credits, which you buy through Stripe checkout. Most tools consume one credit per run. FloorPlan consumes one credit per unique floor layout generated — assigning one layout to several floors costs nothing extra — and the number of credits required is shown before you confirm. Purchased credits do not expire. A free account gives you access to our free city cost check and keeps a record of every estimate you run; credits themselves are purchased. Where we offer a monthly plan, that plan renews automatically until you cancel it, and cancellation takes effect at the end of the period you have already paid for. Prices are those displayed at the time of purchase. If you close your account, your stored estimates, plans and outputs are deleted and any unused credits are forfeited. Any active subscription is cancelled at deletion. Records of your purchases are retained where we are required to keep them. Download anything you wish to keep before closing your account.

Our services do not include: regulated professional advice of any kind, including legal, financial, medical, tax, engineering, appraisal, or construction cost opinions; 24/7 support or guaranteed response times; any use that violates applicable laws or our acceptable use policy. Outputs are informational and are not a substitute for advice from a qualified professional in your jurisdiction. We reserve the right to refuse service to anyone at any time.

Credits and plans are paid for in advance through Stripe checkout; we do not store your card details. Prices are those displayed at the time of purchase. No credit is consumed unless your result is successfully produced and saved. If a run fails after a credit has been taken, that credit is returned to your balance automatically. Completed runs are final. A monthly plan can be cancelled at any time and stops renewing at the end of the paid period; we do not refund the period already paid for. If you dispute a charge, we may suspend or terminate your access while the dispute is resolved.

Upon payment, you receive a perpetual, non-exclusive, worldwide licence to use the outputs you generate for your personal or business purposes. Some outputs reproduce figures published by third parties, such as construction cost guides, which are quoted with attribution under the terms on which their publishers distribute them. The licence above covers our report and its presentation; it does not transfer rights in those publishers' underlying data. You warrant that any materials you submit to us do not infringe third-party intellectual property rights. AI-generated outputs may inadvertently resemble existing works; you are responsible for conducting appropriate trademark and copyright clearance before commercial use. We do not use your data or content to train AI models without your explicit consent.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, RESULTING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

You agree to indemnify, defend, and hold harmless Gamified Labs Inc., its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: your use of our services; your violation of these Terms; your violation of any applicable laws or regulations; your infringement of any third-party rights; any content you submit to us for processing; your use of AI-generated outputs.

We reserve the right to modify these Terms at any time. Material changes will be communicated by email or by prominent notice on our website. Continued use of our services after changes constitutes acceptance of the revised Terms. These Terms are governed by and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable in it, without regard to conflict of law principles. You and Gamified Labs Inc. submit to the exclusive jurisdiction of the courts of Nova Scotia, Canada for any dispute arising out of or relating to these Terms or our services.
